What was the context of your first comment? It reads like you were rebutting some point about juries.
It sounds like his point was that whoever was going to make the ruling, whether juries or judges or whoever, could know about the incident beforehand. I think he’s saying with the second tweet that those individuals are interchangeable for the purpose of his argument.
